These Terms and Conditions apply to the use of fancylight.nl and to purchases made through the Fancy Light online store.
The online store is operated by:

Fancy Light uses Shopify to host and operate the online store.
By placing an order, you agree to these Terms and Conditions. Your statutory consumer rights remain unaffected.
1. Scope
These Terms and Conditions apply to:
- access to and use of our website;
- offers made through our online store;
- orders placed through the online store;
- contracts between Fancy Light and its customers;
- delivery, payment, returns, refunds and customer service.
Additional policies published on our website, including our Privacy Policy, Shipping Policy and Returns and Refunds Policy, also apply where relevant.
Where these Terms conflict with mandatory consumer law, the mandatory legal rules take priority.
2. Eligibility and customer information
You must provide complete and accurate information when placing an order.
This may include your:
- name;
- email address;
- telephone number;
- billing address;
- delivery address;
- payment details.
You are responsible for checking that your order and contact information are correct before completing the purchase.
Fancy Light is not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer, unless the problem was caused by Fancy Light.
Where customer accounts are available, you are responsible for keeping your login details confidential and informing us promptly if you suspect unauthorised access.
3. Product information
We aim to present our products as accurately as reasonably possible.
Product pages may include information such as:
- dimensions;
- colour;
- materials;
- wattage;
- colour temperature;
- technical specifications;
- stock status;
- estimated delivery time;
- product images.
Colours and appearance may vary slightly depending on lighting conditions, screen settings and manufacturing variations.
Small differences that do not materially affect the product’s function or agreed characteristics do not automatically constitute a defect.
However, products must conform to the agreement and to the information provided before purchase. Nothing in these Terms limits your statutory rights where a product is defective, incorrectly described or not fit for its normal purpose.
4. Prices
All consumer prices displayed on our website are shown in euros and include applicable VAT, unless clearly stated otherwise.
Any delivery charges or other unavoidable costs will be shown before you complete your order.
The final total payable will be displayed during checkout.
We may change product prices at any time, but a price change will not affect an order that we have already accepted.
If an obvious pricing error occurs, we may contact you before accepting or dispatching the order. You may then choose to proceed at the correct price or cancel the order for a full refund.
Businesses must provide consumers with required information before the customer places the order, including clear information about the price and relevant charges.
5. Placing an order
Products displayed on our website constitute an invitation to place an order.
When you submit an order, you make an offer to purchase the selected products.
After placing the order, you will normally receive an automated order confirmation. This confirms that we received the order but does not necessarily mean that the order has been accepted.
The contract is concluded when we:
- confirm that the order has been accepted; or
- dispatch the order,
whichever occurs first.
We reserve the right to refuse or cancel an order for legitimate reasons, including:
- a product being unavailable;
- incorrect pricing or product information;
- suspected fraud;
- payment failure;
- delivery being unavailable to the supplied address;
- an obvious technical error;
- quantity restrictions.
When we cancel an order after payment has been received, we will refund the applicable amount using the original payment method.
6. Payment
Available payment methods are displayed during checkout.
Payment must be completed using one of the available methods before the order is processed, unless another arrangement has been agreed in writing.
Payment services may be provided by Shopify or independent payment providers. Their own terms and privacy policies may also apply.
Fancy Light may carry out reasonable payment and fraud checks before accepting or dispatching an order.
7. Delivery
We deliver to the countries and regions shown in our Shipping Policy or during checkout.
Delivery costs and estimated delivery times are displayed before purchase or explained in our Shipping Policy.
Delivery times are estimates unless a specific binding delivery date has been expressly agreed.
We will make reasonable efforts to deliver within the indicated period.
When a delay occurs, we will inform you where reasonably possible and explain the available options.
For consumer purchases, the risk of loss or damage generally remains with Fancy Light until the product is received by you or by a third party designated by you, except where you independently arranged a carrier that was not offered by us.
Your current clause saying risk passes immediately to the customer when the parcel is handed to the carrier should therefore be removed. EU rules place delivery obligations on the seller, and consumer protections cannot simply be removed through general terms.
8. Inspecting the delivery
Please inspect your order within a reasonable time after delivery.
Contact us promptly when:
- the parcel appears damaged;
- a product is missing;
- the wrong product was delivered;
- a product is damaged or defective.
Where possible, include:
- your order number;
- a description of the issue;
- photographs of the packaging;
- photographs or video of the product.
A delay in reporting an issue does not automatically remove your statutory rights.
9. Right of withdrawal and voluntary returns
Consumers purchasing online generally have a statutory right to withdraw from the purchase within 14 days after receiving the product, without giving a reason.
Fancy Light also offers a voluntary 30-day return period, subject to the conditions described in our Returns and Refunds Policy.
The voluntary return period does not reduce or replace the statutory right of withdrawal.

10. Custom and personalised products
The statutory right of withdrawal may not apply to products that are:
- made to the customer’s specifications;
- clearly personalised;
- custom-made specifically for the customer.
Where this exception applies, it will be disclosed before the customer places the order.
A product is not automatically excluded from return merely because it was ordered from a supplier or was not held in local stock.
11. Refunds
Refunds are processed in accordance with our Returns and Refunds Policy and applicable law.
Where a consumer validly withdraws from the full order, we will refund:
- the price paid for the returned products; and
- the cost of the least expensive standard delivery option offered for the original order.
We may withhold the refund until we have received the returned product or until the customer provides evidence that it has been sent back, whichever occurs first.
Refunds are ordinarily made through the original payment method.
12. Legal guarantee and conformity
Products sold by Fancy Light must conform to the purchase agreement.
A product may fail to conform when, for example, it:
- is defective;
- does not match its description;
- does not have the quality or functionality reasonably expected;
- cannot be used for its normal intended purpose;
- lacks agreed accessories or instructions.
Where a product does not conform, you may be entitled to a remedy under applicable consumer law.
Depending on the circumstances, this may include:
- repair;
- replacement;
- price reduction;
- cancellation of the purchase and refund.
Fancy Light does not exclude or limit the statutory legal guarantee.
Dutch guidance makes clear that statutory guarantee rights depend on what a consumer could reasonably expect from the product; there is not always one fixed Dutch guarantee period applicable to every product.
EU consumer rules also provide minimum protection where goods are faulty or do not match their description.
Any commercial or manufacturer’s warranty is additional to, and does not replace, statutory rights.
13. Installation and safe use
Lighting products must be installed and used in accordance with:
- the supplied instructions;
- the product specifications;
- applicable electrical and safety requirements.
Where professional electrical installation is required, installation should be carried out by a suitably qualified person.
Before installation, the customer should verify that the product is suitable for:
- the intended location;
- the electrical supply;
- indoor or outdoor use;
- moisture exposure;
- ceiling or wall structure;
- dimming systems;
- compatible bulbs, drivers or transformers.
Fancy Light is not responsible for damage caused solely by:
- incorrect installation;
- unauthorised modification;
- improper use;
- failure to follow instructions;
- use outside the stated specifications;
- normal wear and tear.
This does not exclude liability where the damage was caused by a defective product, inaccurate instructions or another matter for which Fancy Light is legally responsible.
14. Product availability
All orders are subject to availability.
Stock indicators are updated regularly, but errors or delays may occasionally occur.
When an ordered product becomes unavailable, we may:
- offer an alternative;
- provide a revised delivery estimate;
- cancel the affected product;
- refund the amount paid for that product.
We will not substitute a materially different product without your agreement.
15. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions.
Unless stated otherwise:
- discount codes cannot be exchanged for cash;
- only one code may be used per order;
- codes must be entered before checkout is completed;
- expired codes cannot be applied;
- discounts do not apply retrospectively;
- promotions may be limited to selected products or customers.
Promotional terms will not limit statutory consumer rights.
16. Website use
You may use the website only for lawful purposes.
You must not:
- attempt to gain unauthorised access to the website or its systems;
- introduce viruses, malware or harmful code;
- interfere with the operation or security of the website;
- use the website for fraud or unlawful conduct;
- copy or exploit website content in violation of intellectual-property rights;
- collect personal information about other users without permission;
- submit false, misleading, defamatory or unlawful content.
We may restrict access where reasonably necessary to protect the website, customers or our legal rights.
17. Intellectual property
Unless otherwise stated, the content of the Fancy Light website is owned by or licensed to Al Baraka Rotterdam B.V.
This may include:
- logos;
- branding;
- photographs;
- videos;
- graphics;
- text;
- layouts;
- product descriptions;
- designs.
You may view and use the website for personal, non-commercial purposes.
You may not reproduce, distribute, publish, commercially exploit or modify protected content without prior written permission, except where permitted by law.
Third-party trademarks remain the property of their respective owners.
18. Reviews and submitted content
Where the website allows reviews, photographs or other content to be submitted, you confirm that:
- the content is accurate and based on genuine experience;
- you have the right to submit it;
- it does not infringe another person’s rights;
- it is not unlawful, threatening, discriminatory or misleading;
- it does not contain malware or confidential information.
You grant Fancy Light a non-exclusive, worldwide and royalty-free right to display and reproduce submitted content for operating and promoting the store.
We may moderate or remove content where reasonably necessary, but we are not obligated to publish every submission.
We will not materially alter a customer review in a way that changes its meaning.
19. Third-party services and links
Our website may contain links to or functions supplied by third parties, including:
- Shopify;
- payment providers;
- delivery services;
- social-media services;
- communication tools;
- analytics providers.
Third parties may apply their own terms and privacy policies.
Fancy Light is not responsible for independent third-party websites or services that it does not control.
However, using a third-party service provider does not remove Fancy Light’s legal obligations relating to its own sale of products.
20. Shopify
Our online store is hosted by Shopify.
Shopify provides ecommerce infrastructure, hosting, checkout and related technical services.
Purchases made through our store are contracts directly between the customer and Al Baraka Rotterdam B.V., trading as Fancy Light.
Shopify is not the seller of Fancy Light products.
21. Privacy
We process personal information in accordance with our Privacy Policy.
Our Privacy Policy explains:
- what information we collect;
- why we use it;
- who may receive it;
- how long it may be retained;
- your privacy rights;
- how to contact us.
The Privacy Policy is available through the footer of our website.
22. Liability
Fancy Light is responsible for losses that are a foreseeable result of:
- our breach of the agreement;
- defective products;
- negligence;
- another legal basis for liability.
Fancy Light is not responsible for losses caused exclusively by:
- misuse of a product;
- incorrect installation;
- failure to follow instructions;
- unauthorised product modification;
- incorrect information provided by the customer;
- events outside our reasonable control, except where the law places responsibility on us.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for:
- death or personal injury caused by negligence;
- fraud;
- intentional misconduct;
- mandatory product-safety obligations;
- statutory consumer rights.
The extremely broad warranty disclaimers and liability exclusions in your current template should not be retained. A term that conflicts with mandatory consumer law may be invalid even when included in accepted general terms.
23. Force majeure
We are not responsible for a delay or failure caused by an event outside our reasonable control, such as:
- severe weather;
- natural disaster;
- war;
- civil unrest;
- government action;
- widespread transport disruption;
- major telecommunications failure;
- power outage;
- epidemic;
- carrier interruption.
We will take reasonable steps to reduce the effect of the event and resume performance.
This clause does not remove rights that consumers have under mandatory law, including rights arising from excessive delivery delay.
24. Complaints
Complaints may be submitted by email to:
Please include:
- your name;
- order number;
- a description of the complaint;
- relevant documents or photographs;
- the outcome you are requesting.
We will acknowledge and handle complaints within a reasonable period.
Submitting a complaint does not limit your right to use any available legal or dispute-resolution procedure.
25. Governing law
These Terms and any contract between Fancy Light and the customer are governed by Dutch law.
Where the customer is a consumer living in another EU country, this choice of law does not remove mandatory consumer protections available under the law of the customer’s country of residence.
Disputes may be submitted to the competent court under applicable law.
The current reference to unspecified “federal and state or territorial courts” is unsuitable for a Dutch business and should be deleted.
26. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective.
The invalid provision will be interpreted or replaced only to the extent necessary to make it legally valid while preserving its intended purpose as closely as possible.
27. Changes to these Terms
We may update these Terms from time to time.
The version applicable to an order is the version made available when the order was placed.
Changes will not retroactively alter an existing purchase contract unless required by law or agreed with the customer.
The current version and revision date will be published on this page.
